Legal Question in Family Law in Georgia

My son is 5 years old - he was born here in GA, where I'm from and we live here. His father lives in Missouri, we were never married (nor did we ever have plans on staying together), and he is not listed on the birth certificate. The last time he saw my son was when he was 3 days old. He has never participated in his life, nor does he pay any child support at all. No child support order was ever ordered by the court. Should I file for sole custody through the courts as a "cya factor" and would it be easier to be granted considering these circumstances?

You already have sole custody under Georgia law now. The easiest way to risk that would be to summon the father into court, which makes it easier for him to seek custody or visitation. If you are concerned with him seeking custody, doing nothing is a far better option than creating a dispute where none yet exists.
