How did you enter the house and take your daughter?

Can her father call the police and charge you for trespassing?

(And regardless of that, what does your lawyer say? Obviously when you have a custody dispute the FIRST thing you do before anything else is to see a lawyer BEFORE you mess up and do something wrong).

I'm assuming there is no custody order in place. Without one you and your wife have equal rights to the child. However, the court frowns on a tug of war over the child. Hopefully when you "took" the child there was no scene. Rather than continuing to place your child in the middle, I suggest you seek the counsel of an attorney.
