Legal Question in Civil Litigation in Georgia

condo above me leaking down into my unit.

My neihbors bathrooms above me leaked down into my condo. I did not realize it until the ceiling in my unit caved in. There was almost 8,000.00 in damages. The plumbing company that did his repairs gave me a statement of neglect on his part. He was not caulking around his tubs, and also had faucet leaking, which was running down edge of tub and into my unit. Again no caulking.

He is an attorney and will not do anything until I let his dads contractor look at it. I have refused.

I have an estimate. Is he responsible and how do I pursue?? Does he have the right to have a contractor come in and evaluate?

Well, there is your problem, "he is an attorney." Who cares whether his "dads contractor" looks at it. If he damaged your condo -- and you can prove it within the confines of the Georgia Rules of Civil Procedure and Evidence, then he should pay the damages necessary to fix it -- or make you whole.

Given that he is an attorney, you may want to consider getting him to agree to binding arb. Or, if he won't then, simply sue him in State (not Magistrate) Court. Good Luck

I agree with other attorney response: You should contact an attorney to represent you since you are dealing with an attorney.
