Legal Question in Civil Litigation in Georgia

Rule Nisi Motion for contemp

I'm a soldier living in KY. I was divorced 1993 in Ga. I agreed to pay $6000 to several creditors of my Ex's. I could not make the payments after a while. I recieved a summons to appear for May 99.

I may not be able to respond in time due to the lateness of the summons. I understand that a judgement by default will occur. I'm concerned about the contempt of court. What is going to happen to me? What shall I do? Thanks

Hire a lawyer -- fast! You do, however, have special rights as a serviceman. But, you've got to know what they are and how to use them. Were you represented by an attorney in your divorce? If so, can you not contact him/her? I assume that since this is a contempt hearing, you had agreed to assume these debts in your divorce settlement agreement that has been incorporated into the final divorce decree. It this is true, your going to have to show changed financial circumstances (less income) than when you were first divorced. Otherwise, if your income hasn't changed, or has increased, the court may force you to pay.
