Legal Question in Immigration Law in Georgia

can i apply for tourist visa to the usa? i have son and my name is on his birth certificate.

okay so, im from Belo Horizonte,MG but i used to live in gainesville,GA USA.when i was 4 years old my mother and father went to the USA under tourist visa and decided to stay.We stayed for 12 years,but earlier this year my father was pulled over by the police and was taken to immigration jail.they offered him a bond and let him out,with 120 days to leave the country.so i joined him.when i left usa i was 16.im 17 now and 5 months before i left my child was born and my name is on his birth certificate.me and my girlfreind are still togethor and we speak on the phone everyday.im in brazil and i want to know if i will have any problems applying for a toursit visa to see him for his first birthday in april.

also,when i go to apply should i get emancipated first? my parents will be paying for all costs.

Since you left the country before you turned 18 you should not be counted as having accumulated unlawful presence. You should be able to enter the country as a visitor but make sure you don't overstay or you won't be able to return for a long time.
