Wrongful Death

My brother was killed in car accident. He was a twin 24 yrs of age. He and his friend were killed by a female driving down the wrong way on the hwy and pending results to believe she was drunk. Their dad is trying in the picture after never being there 24 yrs of being in prison, getting a lawyer to sue. Our mother was killed when they were 8 so I have pretty much been their caretaker for 24 yrs. Noone but my grandmother had legal custody of them and she died in 2001. I have proof that i was their beneficary when they were 17&18 yrs of age. But that doesnt matter to me cause im not the one trying to sue. I know that i have been there always and so do they. The point is i dont want their dad to benefit from his death because he has never paid child support or done anything for them. I was wondering if the surviving twin has any rights to benefit from this and noone else? Please help me..If you want to read anything about my brother that died, go on the internet to search and type in Corey Blackstone. I cant hardly sleep at night knowing this man would benefit from him. Please help me. Thanks April

The spouse has the first right to file suit and then the children. Unfortunately, siblings have no standing to file suit for the wrongful death of their sibling.
