Escrow Agreement Executed or Not Executed?

Question - If escrow account was set up in 1992 however, client never submitted any deposit material is the agreement still binding? Note a deposit account number was never assigned, and annual fees were never paid dating back to 1992, my thoughts are then the agreement was never executed.
