Legal Question in Landlord & Tenant Law in Georgia

Early lease Termination

I have had ongoing issues with my landlord. She offered to let us out of the lease a in April but we did not accept at that time. However, we have since decided to purchase a house. The lease has no provision for early termination and does not address any penalties for doing so. In the absence of that provision, what, if anything would we be responsible for if the lease is terminated early? Does she have the right to withhold our security deposit?

Re: Early lease Termination

It may depend on many factors, but generally the breach of a contract (as opposed to "early termination" under the terms of the lease) entitles the landlord to damages, which may very well include lost rent until the end of the term. You security deposit may be small compared to that. Your best case is to negotiate with the landlord for early termination, and get any agreement in writing.
