Legal Question in Landlord & Tenant Law in Georgia

We have just moved last month in new apt. & my landlord (GM) already sent me 2 notice saying kids cannot play in the house as it is disturbing to downstairs apt. people while they walk or run in the house & now they are threatening us if it doesn't stop than we will have to evict the apt.

May note that the said apt building are quite old & the flooring is not good at all , even we an adult walk in the apt. it is making lots of noise. We have 2 kids 5 years & 2 years old & the apt. office expecting them to act like grown up.

So please advice us as what to do & how to stop getting bothered by landlord

Unfortunately, no one on this website can put themselves in your position, or the position of the downstairs neighbors. Apartment noise is a common issue, but it just depends on the actual level of noise that we can't hear. Is it normal walking, or are the kids jumping and yelling and being kids? While you say the office is expecting your kids to act as grownups, certainly you can understand that the downstairs neighbors expects to be able to use their home without excess noise from someone else's children even if it is "normal" kids play. They CAN expect your kids to be reasonably quiet. It was probably a bad idea for both you and the landlord to move into an upstairs space that can be noisy. Again, we don't know the level of noise. If it continues, you can certainly expect to have continued problems and possibly face eviction. One resolution might be for you and the landlord to agree (in writing) to terminate your lease with no penalties and you can move to a more appropriate place. That could be a much better long term move for you.
