Legal Question in Landlord & Tenant Law in Georgia

We are in the state of Georgia, and rent a property from a certain entity. After our lease ended, we never received a renewed lease to sign. We have continued to pay rent, even after the last lease we received ended. Since last year, we have contacted them requesting that they give us a lease reflecting the past two years. And just since a few weeks ago, I myself have received from them promises to send us new leases on two different occasions, but we never get leases either time. In short, we ask for the leases. They says they are going to send them to us, and we even agree on a time frame for us to receive the leases, but we never receive them. What can we do, legally?

Not much. The owner cannot be compelled to give you a lease. Therefore, you are considered a tenant at sufferance or a tenant at will. This means that either you or the owner can give 30 days notice to terminate your rental of the property. You cannot be evicted without this notice and the time period elapsing therefrom. However, the owner could decide to go up on the rent, then give you 30 days notice to vacate if you don't pay more. For many people, this is not a problem and gives you flexibility if you find a better place. For others, lack of permanency could be a good reason to go ahead and start looking at somewhere else to live.
