Legal Question in Personal Injury in Georgia

My former employer used my photo, likeness in advertising brochures and website. When I noticed it in brochure I mentioned it to him ,he shrugged it off and laughed. Soon after I was fired and realized he had the same photo on our website so I hired attorney sent a demand letter and his response via his attorney was I knew about the photos and statute had expired! He never had my consent, I never signed anything permitting such and the nerve he fired me wrongful termination which i appealed unem.claim and won!
