Legal Question in Personal Injury in Georgia

rear ended in atlanta

i was rear-ended near downtown on i-75/85. the lady behind me hit me doing about 45 or 50 (she was cited for following too closely), totaled her car, and pushed me into the car in front of me. that pushed the car in front of me into the car in front of her. my neck and shoulders, upper back hurt, doc doesn't think injury too serious, haven't been to chiro yet. if her insurance company fixes my car and pays med/chiropractor bills, should i expect a pain and injury settlement as well? if so, what might be considered reasonable?

Insurance companies will always take advantage of an unrepresented person, and it is rather likely that even after deducting attorneys fees you will receive less on your own than you would with counsel, although no one can evaluate the case without more information. It is very rare for an insurer to pay an unrepresented person adequately.

In the meantime, it is VERY important that you give no statements to the insurer at all.

My office is experienced in such matters. If you would like our assistance, there is no charge for the initial visit, and as a general rule we only charge fees as a percentage of any recovery. Feel free to call me and we can determine what you should do in your case.

Time is very critical in these cases, and a delay can impair your rights or prevent you from any settlement at all.

That amount may or may not be reasonable. However, it does not even look like you know the extent of the discomfort so no one else can guess. If it all goes away in a couple days, you may very well be ahead by settling for actual damages to the car (incluing diminution in value) and all medical bills, as opposed to getting a higher number and giving 40% to the lawyer. There is no way to speculate.
