Contested Ownership

I have a friend thats has been living on this particular piece of property for a number of years. It is recorded in her name at the courthouse, the plat describes the property when it was resurveyed, when the timper was cut, she was informed that she did not own the property. The property is recordey as having been handed down to her from her mother, she has that also. The person claiming the land is supposingly going on the word of someone that has alter motives. what should she do. She has to go to court soon to defend herself.

To determine who owns a piece of property, one must do a title search on the real estate records at the courthouse. Typically, 50 or 60 years of title records are searched, and if someone held the property from the 1920's until the 1950's, the search would go all the way back to the 1920's. Without doing such a search, and determining what the state of the title is on the record, there is no way to determine who actually owns the property or if there is a title problem.
