division of property

60 acreas and a 3bedroom brick home was deeded to 3 adult children. 5 years later one child needed colateral so the other two children deeded him 12 acreas. now the property needs to be divided and the first child feels he is due a third of the remaining property even though he has already received 12 acreas. we feel he is due a third of the house and 8 acreas of land.. please help

Well, based on the few facts and assuming no other agreements were made when the 12 acres was cut off, then I think you are correct: He gets .333 of the House and 8 acres. HCW
