Legal Question in Real Estate Law in Georgia

Heir Property?

My husbands' mother is entitled to land deeded to her deceased husband and several other siblings in GA. 2 of the siblings are alive, and not interested in selling. How can she sell the portion of the land she is entitled to as his widow. There is no will.

Re: Heir Property?

First, open administration of the deceased husband's estate.

Second, bring a partition action to force sale of the land. This could be done either by your mother as administrator, or by her as her husband's heir.

The assistance of an attorney will be required for both steps.

Re: Heir Property?

Keep in mind before starting a legal battle with family that a partition action, like any lawsuit, is expensive (likely several thousand dollars) and may very well eat up much of the partial value of the property. Perhaps the other two will want to buy her interest.
