Legal Question in Real Estate Law in Georgia

Landlord threatening lease termination

I have been a tenant for 5 years at an apartment complex. In my lease there is a clause that says I shall not use my premises in any way that violates the law. It also has a clause about default, saying that my lease can be terminated if I do not pay my rent. I have a downstairs neighbor who has been complaining to the management company that I have been making noise early in the morning, when in fact I had to call the police on this person a few times. Now management has sent me two letters threatening that they will terminate my lease if I do not resolve the situation. I have paid my rent. I have 10 months left on the lease. Can these people at the management office evict me for making noise, noise that is confined to my apartment and is not out of the ordinary? Isn't it up to the police to decide these matters? What are my rights?

Thanks for any assistance you might have to offer.

Re: Landlord threatening lease termination

The apt. complex can evict you for this and will probably win, if they are willing to put on evidence of the noise at an incourt hearing. (Many times the apts. never want to go that far). Either resolve the noise situation or consider moving. HCW
