Misrespresentation on Property Disclosure

I made on offer on a house for which the seller had indicated ''no' polybutylene plumbing on the disclosure. My $300 inspection revealed polybutylene plumbing throughout. After unsuccessful counter offerings, we could not reach agreement so the sale was terminated. Can I recoup the $300 inspection fee since I would not have pursued a property with this type of plumbing? My offer was contingent upon false statements on the disclosure.

An inspection is a cost of doing business when purchasing a house (like gas, time off from work, etc.). Based on the wording of your post, it appears the issue did not keep you from pursuing and making an offer.
