Legal Question in Real Estate Law in Georgia

Hello - my parents need to kick my brother out of the house but have been told by police this is not a simple process and would require the issuance of an eviction notice. I understand that process can be complicated and take up to two months.

Is what the police said actually the case, or is there a way to more quickly get my brother out of my parents' home? He has stolen from them, does not pay rent and causes them immense emotional distress. He is 20 and has not been diagnosed as mentally ill, so there should be no obstacles in those regards. Thanks for your help.

Your parents would have to file a dispossessory warrant against your brother in the magistrate court where the property is located. The process typically takes about three or four weeks, but it depends on how busy the court is. Also, the tenant has the right to appeal, which substantially lengthens the process.
