If my father resided and passed away in 1986 in the state of. Florida and no autopsy was performed since he had remarried do his children by his first marriage have the rights to request a autopsy now in 2014.

What for?

Just because someone dies does not mean an autopsy should be done. What is listed on the death certificate as the cause of death?

You would have to ask an attorney in FL if your father resided in FL at the time of his death, But this was 28 years ago. Why now? What would an autopsy reveal? Is murder suspected and if so how? Tests can be done depending on the suspected cause of death. Is the step-mother still alive? Can her lack of consent be over-ridden by children? I don't know the answers to those questions but if your father died in FL and FL law governed then you need to ask a FL attorney.
