Legal Question in Personal Injury in Hawaii

Is there a case?

I was recently involved in a car accident a couple days ago. which a truck ran a red light while I was entering the intersection. which it crashed into my car. I'm not hurt but mentally i still have back flashes from the accidents which sometimes makes me have a hard time focus on my job. my car can't be repaired because its totally damage and im not satisfied with the settlement my insurance have for me which is they would pay the remaining balance on my car which is not much and i would atleast have a thousand dollars left over from the insurance. I feel like im losing out. so my question is, is there a case I could fight for? can a see a lawyer about this?

Unless you suffered some physical injury and unless you have medical or other treatment bills totalling at least $5000, you will likely not be able to obtain compensation for your emotional distress. With regard to your property damage, the insurance company will not pay you based upon your loan balance but rather will pay the fair market value of your vehicle. You should get three advertisements for similar vehicles (same year, make, model, features, mileage) that support your desired value and submit them to the insurance company to show that they are not offering you enough.
