If the company is community property of your marriage you can transfer your 50% share to your wife and disclaim it to recharacterize it as her separate property. If its is your own separate property (owned before marriage), you can also transfer it to her as her separate property. However, NEITHER will protect you from being held responsible still to some third-parties in some situations or for any future Court Judgment debt against your wife. There are ways to do those items, but it needs some serious work to get good documents in place. You really need an Attorney to draft those up effectively in Texas. I've done many small and medium size business sales, mergers, split-ups. If you want a free 30 minute meeting at your business to evaluate what you've got and may need, please contact me. I can do it later this week or in the early evenings.

Good Luck.
