Legal Question in Family Law in Idaho

Copy of taxes for child support

I believe that my ex-wife is receiving income from a trust. I also believe that this money has to be claimed as income on her income taxes. She is requesting an increase in child support and claiming no income. I believe that she is not presenting the state with all appropriate income paperwork. Can the state request a copy of her federal income tax from the government if she refuses?

Re: Copy of taxes for child support

You can request it through your attorney, which you should have in this procedure, or you can serve on her interrogatories and request for production of documents that she must answer under oath. Your attorney can question her on the witness stand. You might also file a motion before the court requesting he order the same. I give a 1/2 hour free consultation in my office-208-345-3817
