Taking a child out of State

If I divorce my husband can I legally move and take my child to another state?

You can, but if you don't want the court to find you in contempt or the prosecutor to file parental kidnapping charges against, you should either get an agreement in writing with the father or go to court and get a court order allowing you to leave and setting forth the new visitation schedule.

You have a constitutional right to travel between the states, but this right is regulated as set forth above.
