Legal Question in Business Law in Illinois

We have a cleaning contract for a local business- a fixed dollar amount for the year billed monthly. They had a fire and will be temporarily shut down for several weeks, mostly due to smoke damage. Are they obligated to pay us while the bldg is being "de-smoked"?

Whether or not they are obligated to pay you depends on the terms of your contract. I suggest you have the contract reviewed to determine if you are entitled to payments or not.

As a franchise attorney I can say the answer depends on the terms of your contract. Another issue is whether you will be obligate to partipate in the clean up. Consult with a good business or franchise attorney in your area for specific advice.

While it does depend on what your contract says, I would think it might be a good idea to give them a break, if they are required to pay under the contract. This company is going through a very difficult time--the last thing they need is to have to pay out money when no services are being given in return. You might even ask them if there is anything you can do to help. Just a thought.
