A business was purchased with an 800#, the 800# uses a different business name than the name of the business. The business & the 800# were originally uner the same name, but the owner decided to go out on his own with the same type of business including some of the same products. The business name was changed but the 800# remained the same leading me to believe that the 800# was not changed in order to interecpt the business of the more predominant established business. It has been this way for at least 2 years. Is this legal?

Your facts are a bit sketchy. It is unclear whether a claim against this "business owner" would be made by the former company, which used to "own" the phone number that this business owner took when he "went out on his own," or whether a claim would be made by a patron who called the telephone number expecting to receive the former company and, instead, received the new company.

If the latter, then I would need to know certain additional facts, such as what are the differences between the former & new companies, why do those differences matter to a caller and how has that caller been damaged, among other questions?
