Legal Question in Civil Rights Law in Illinois

What about an unpaid medical leave, does ther have to be fifty or more employees working for the company.

Not necessarily; as you note FMLA only applies to companies with a minimum # of employees. BUT if the company has its OWN benefits program, or is subject to a union collective bargaining agreement that provides such benefits, OR it has no real benefit program but ownership is "understanding" -- anything can happen. BUT if it's NOT part of a regular program you might want to get it documented so that when you come back...there's still a job.
