Legal Question in Consumer Law in Illinois

Alcohol Identification Question

As you know, after one turns 21 he/she has 3 months under law to re-new their ID. To simply make an ID easier to notice a person is under 21, an over 21 and under 21 ID differ in color and markings. However, I have heard and witnessed many establishments refusing to sell alcohol to customers who present a valid driver's license simply because the ID is red. I do not see how this is right. A red ID is still a valid ID. After the 3 month period when one's ID expires, I could see how this would be legal.

I will be turning 21 at mid-night tonight. So, if I were to try and buy alcohol at 12:01 am and am refused service, isn't this a restriction of my rights? I have obviously not had time to purchase a new ID. Please tell me if this is legal, and explain how if it is.

Re: Alcohol Identification Question

A business can generally refuse service to almost anyone. Of course, you cannot discriminate on race and other related criteria. The thinking behind the business owners is probably that the ID might be a forgery. I would just go to the license branch and obtain a new ID on your 21st birthday.
