Legal Question in Consumer Law in Illinois

Cancelling a contract

I decided to purchase a dog from a breeder (in Texas) and she faxed me a contract to sign and fax back. When I received the contract all the fill-in information as blank. She said this was normal and once I signed the contract and sent it back to her she would fill-in the all the information, sign it and send it back.

When the contract was faxed back there was an area of information that was left blank.

Can I cancel the contract because of missing information?

Also, no where on the contract does it state that there is a penalty for cancelling the contract.

Re: Cancelling a contract

It depends on whether the part of your contract that was left blank was an essential and necessay term for the making of the contract. Generally, only if it was essential do you have the right to void the contract. Not having seen the contract, I cannot comment on our particular contract.

Re: Cancelling a contract

It is very possible - but really an attorney must see the contract to give oyu a full opinion. If she has not depended on the contract and had costs already, you could probably rescind the contract - but, again, until the contract is seen, it is too difficult to give an opinion.
