Legal Question in Consumer Law in Illinois

money owed

i bought a car For $5,500 dollars and took a loan out for $11,000. the difference was too do some extras and pay off some debt. I gave the check to the person i bought the car from and he put it in his account and was to give me the dfference back. in the mean time he had filed bankruptcy on some medical bills and they froze the account and took the monies. He had signed and dated a promisarry note of repayment for the money and never did. he moved a month later a changed his phone number and that was that. this was in 1996 and recently i moved and dug out the papper and found him. i have not confronted him because i dont want see him run again and was wondering if there is anything legal that can still be done or did i wait to long?

I think it's way too late, you should've hired an attorney to assist you in that when he filed bankruptcy. It is arguably discharged now, and even if it wasn't discharged the statute of limitations most certainly has run.
