Legal Question in Credit and Debt Law in Illinois

Collection Notice for disputed charges

Background: My wife signed up two

of our kids for gymnastics at a local

place. After many happy months the

place discontinued the program my

daughters were taking. They asked

them to try a different class and see

if they like it. They did try another

one for a month (of which we did pay

all fees) and didn't like the new

program. My wife verbally notified

the gym that we would not continue

and subsequently sent a letter with a

check for payment of the last months

fees.

The gym owner contacted us right

away, claimed no letter was received

(not possible, it was sent with the

check, and they cashed the check),

and stated their policy is that they

need at least a 30 day notice

therefore we owe her another $200.

We told her that we did not believe

we owed her another $200, she in

fact, discontinued the program,

therefore we were not given an

opportunity to give any notice.

A collection arrived yesterday for

$380, without any detail of the fees

owed.

We are not sure what to do in this

case. Should we dispute or pay it?

Thank you - Dan & Michele
