Legal Question in Credit and Debt Law in Illinois

credit card debt summons

I have been summoned to court over an old credit card debt. Are there any statute of limitations laws in Illinois regarding this? The debt was acquired between 1998-2001. The last payment I made was in either 2001 or 2002. I make less than $20,000 per year and there is no way I can afford to pay this debt. Will my income and current bills be taken into consideration? Any suggestions?

Statute is 10 years from the date of last payment.

My suggestion would be to file a chapter 7 Bankruptcy.
