Legal Question in Credit and Debt Law in Illinois

financial liability

my father just passed away and my mother found out there were several credit cards that she did not know about. If she was not a joint signer to open tha credit card, is she legally responsible for the debt as a spouse??

Re: financial liability

While I may not provide you with specific legal advice because you are not as yet my client, I can say that generally speaking a claim for debt against a decedent may result in a claim against his estate, leaving less for the surviving spouse. The end result could be the same for the spouse as if she were legally responsible for the debt directly.
