Legal Question in Credit and Debt Law in Illinois

Hi,

I had a car registered under my name that was driven by my brother. Long story short, he managed to rack up $12,000 in fees/violations on the Illinois Tollway that I am now being sent to Collections for. I am also in jeopardy of having my license and/or plates suspended. I am unsure of what to do.

Get the money from your brother. Put the car in his name. As the owner I believe you are responsible for the fines.

Since the Illinois Toll authority tracks violations by license plate number, they have no way to distinguish whether the owner of the car or a guest is driving the car. You have two choices, you can pass the bill to your brother and make sure he pays the debt or you can pay the debt yourself and seek reimbursement from your brother.
