Legal Question in Credit and Debt Law in Illinois

We owe Beneficial worth $7,000 and forwarded our debt to Freedman Anselmo Lindberg & Rappe LLC (the greediest debt collector)but due to bad advice of our debt negotiator,they sued us in court and made us to pay $9,000 ! We have a monthly plan to pay $500 every month which we were able to do and we have a remaining balance of $2,900. We usually call Freedman and give our check nos. for 5 checks (for 5 months) then we call again if it's on the 5th month and informed them again our check nos. for the succeeding payments.Last July2010 we called and informed them of our 5 monthlypayments ,we thought that it was good to go as we normally did but today,we received a letter from them a Wage Deduction Notice because we weren't paying since July 2010! On our part,we had change our phone number and we didn't notice it in our bank statement either. When we called their office and asked about the Wage Notice and asked them if we will just go back to our previous payment plan where we gave the check # for 5 months, they said we have to pay the remaining balance of $2,000 within 3-4 days before they can stop the Wage deduction). I called them and informed them I have the check # issued for the 5 months and the name who received the payment plan,and asked why they issued the Wage Deduction Notice when if they can't reach us thru phone , they have our address? They said they need to verify the cheques first,which we never did before. My question is can I stop their Wage Deduction demand and continue the monthly payment plan we have? Thanks !

You needed to have an attorney represent you in this matter from the beginning, and you are now facing the consequences of not having your own attorney. It may be possible to file a Motion to Quash or some other pleading to attack the Wage Deduction, and in many cases a debtor's attorney can get better cooperation from the creditor's attorney than the debtor can on his or her own. I would strongly advise you to hire an attorney.
