Legal Question in Criminal Law in Illinois

Aggravated Battery of a Police Officer? Help!

I am charged with resisting arrest and aggravated battery of a police officer, whic is a FELONY! I have no prior convictions, or arrests and NO experience with the law. I am seeing a lawyer on thur but I can't get this out of my mind and I am just going crazy. What happened was I was underage drinking, cops arrived, I ran out back door, cop grabbed my arm and shirtsleeve, I kept running, my shirt ripped and she fell down an 8 inch step off the patio. No one was injured. The officers claim I put both hands on her chest and shoved her to the ground!!!!

1- How is it aggravated battery since no one was injured and there was never a direct or implied threat by myself for physical violence of any kind?

2- How will anyone take my side of the story seriously, that I did not shove the officer, just kept running, when she is a police officer and I was an 18 year old breaking the law? Oh, it was just another 18 year old drunk I am so scared, I realize that in theory the police could say anything and who is the judge/jury going to believe? I am so incredible scared!

3- What are my chances of getting the felony reduced to a misdemeanor? I have no prior contact with the law enforcement.

Re: Aggravated Battery of a Police Officer? Help!

Hello. First of all, stay

calm so that on Thursday

when you see the attorney,

you can relate the details

to him or her clearly. The

smartest move you made is to

contact a lawyer. In a

situation like this, your

attorney may decide to have

a conference with the Judge

and State's Attorney, or

he may decide to file certain

motions. Jury trials are

great because the average

citizen, that you and your

attorney take part in

selecting, gets to decide

your case and that takes

the judge off the hook

(so to say). Listen to your

lawyer, follow his instruc-

tions and tell him all of

the details.
