shouldn't she be out of jail?

My mom was placed on drug court and unsuccessfully dismissed from the drug court program and sentanced to 180 days in a county jail. she has now sat 92 days in jail, which reflects her good time (day for day) at 90 days. she was served a notice to appear on a petition to revoke probation after she recieved her sentance. she has a public defender who does not have time for her she has tried calling him and sending a letter, and still no response.If the state's attourney isn't willing to honor the notice to appear that he signed, shouldn't she be able to bond out?

The problem that your mother has is she is serving a sentence. She can't get bail for that. Even if she is beyond her purported out date. Otherwise, she is probably being held for the probation violation. The judge may have given her a "no bail" order. There is a lot here that can't be answered because you don't have adequate information. If the Public Defender is not representing your mother properly, call his/her supervisor. You may have to hire a lawyer to straighten all this out.
