my 2nd DUI

I was prosecuted for my 2nd DUI and I wasnt even driving. How do I get out of it?

If you have already been found guilty, you are pretty much stuck. It would cost more than getting it removed is worth, and almost impossible to get it removed anyway. You do not necessarily have to be in the act of driving to get a DUI. My gut tells me you fell within the statute for DUI, since prosecutors have to meet the statutory guidelines before a judge will allow the case to go forward.

I think that it is obvious that you need to hire an attorney. If you were not driving, then an attorney should be able to get the case dismissed either before or after a trial. You do not want to take the risk of being convicted especially because this is your second DWI. If you do not already have an attorney, you may contact me at my office. I may be able to help you.
