You need to file a civil lawsuit against the driver, or more precisely, his insurance company. From your description, it sounds like you have a good case. Our firm handles these cases and does not charge you any fees whatsoever unless you recover money from the other side.

If you would like to speak to an attorney who can give you more information, contact our firm and let us know the best way to reach you.

You have to sue the driver of the car that hit your son. If his insurance is inadequate, or he doesn't have any, you must approach your insurance company. Many counties have a victim assistance program. Ask the State's Attorney for details.
