Legal Question in DUI Law in Illinois

Hi, The law has changed in illinois over the past few years regaurding dui's. Now I am not a lawyer and haven't consulted one yet to deal with the secretary of state. My question is reguarding the date I was charged versed the date i was convicted. What does the law apply to. Now for the other part. I moved out of state after I recieved my second dui, and I have completed all the requirements for the court, and I was sentenced a two year revocation of my driving privelages. I wanted to get a RDP so I applied for an out of state dui application for a formal hearing. The sos sent me back a form saying my license won't be able to be reinstated for 5 years. I wasn't asking them for reinstatement but wanted a RDP. I have never had one before and don't know how to get one. Any answers.

You WILL to have to go through a "Formal Hearing" to request an RDP.

I have done several of these, but none where the Petitioner was physically out of Illinois.

If you want to retain me I can take a look at your paperwork and get back to you regarding what you need to do. It may involve traveling back to Illinois for a Secretary of State "Formal Hearing".
