Legal Question in DUI Law in Illinois

If I am sleeping in an RV in the parking lot of a bar (which I was in just prior). Can I be charged with a DUI? This was submitted as a free question.

I suppose that it is obvious that you can be charged. The better question might be whether you can defend such a charge on the grounds that you were not operating a motor vehicle. If you have been charged, you need to hire an attorney as soon as possible.

Mr. Nack's reponse is very appropriate. You certainly can be charged with DUI. That really is not the issue, however. The issue is whether you were in actual control of the vehicle at the time of the stop and arrest. Hire a lawyer and do not give any statements.
