Abuse of a disabled relative & benefits

My brother was injured years ago and since has received SSI, and although mentally disabled, is very motivated and when medicated is willing and eager to work odd jobs. He was homeless and in and out of instititutions under my parent's care for most of my childhood. Our parent is listed as payee on his benefit checks, but is allowing a mate to abuse a portion of the money for a drug habit, etc. In the past there was even a mention from my parent, about finding that the medicine dosage, etc. was incorrect, but nothing was done. I am concerned about my brother's life, well being and future. I would like him to be able to live decently as independent as possible and ensure he's getting the proper medications. As an adult sibling do I have any rights to intervene with his care and future? Is it necessary to take my parent to court concerning this?

Of course you have a right to intervene here, you are his brother. You need to go to court and have an attorney motion the court to change the guardian of your brother (assuming it is currently your parent). The sooner the better, from the sound of it. I am handling a very similar case right now, and I can assure you, it is better addressed as soon as possible.
