Legal Question in Family Law in Illinois

car/divorce

my car is in my husband name due to my past credit the loan is in his name. I have made the payments. when the car was purchased it was purchased 7 months before we married. The car was mine he said just make the payments. I left him we have it worked out where i take him to work still and I keep the car. He has dui's and is excluded himself as the driver of the car. I'm the only authorized driver through the insurance. i wii still be making the payments but only through my own account. my question is even though the car was purchsed 7 months before we married is my chances good to keep the car. That is the only thing i want out of this marriage.

Re: car/divorce

You are much better off if you can get him to put the car in your name - hopefully he will be agreeable since you are driving him to work every day.

If you have to go to Court to figure out how to divide the property, there is always a chance that the Judge will give him the car because it is in his name. But if you have made the payments (and can prove that) and you can show that you are the one who has used the car, then you have a good argument to make to the Judge.

Please feel free to give us a call if you want to talk more about how to go about making a formal claim for the truck.
