Can the father of my child take legal custody from me without both of us going to court?

Yes, a court can order things usually so-called emergency motions on an ex parte basis (meaning no notice to the other party). But typically this is only done on a temporary basis if there's some great danger at issue and then typically another court date would be set shortly thereafter to get both parties into the case to hear what's really going on.
