Child support and Maintenance

I would like to know if an unemployed wife with no money can get maintenance and child support while going through the divorce process if she was to leave the home with the child? And what steps, if any, would you have to do to do this? My husband has always supported me throughout the whole 7 years of marriage. I'm in IL. Thanks.

Absolutely. I think I am not sure if you are the same person I replied to earlier or not. In such cases, I would file a motion for temporary maintenance and temporary child support. If you were in a situation where you needed money immediately, it could be done on an emergency basis within a few days.

You, or your attorney, would need to file a petition for temporary relief which sets out your financial condition and lays out your husband's ability to pay. You would be able to get temporary maintenance and child support until a permenant order was entered. You may also file a petition to have your husband pay for some of your attorney fees as well.
