Legal Question in Family Law in Illinois

Child Support

I pay child support for my 17yr. old daughter-who now lives with me. I also owe back support-that isn't taken out of my check, yet. We had a verbal agreement that I would help with everything our daughter needed, so he never pushed the issue until now. What do I have to do to stop the payments, as she is living with me? And will he have to take me to court for any past support?

Re: Child Support

Hello. First of all you need to get into court

as soon as possible and file a petition for

custody of your daughter. The fact that she

lives with you will not relieve you of child

support, until you seek a legal change of custody

from the court. I know this sounds silly, but I

am familiar with this type of situation. Dad

will have to take you to court to get back sup-

port. The amount will have to be determined by

the court, unless you and he can reach an agree-

ment. I will be happy to answer any additional

questions that you might have.
