Legal Question in Family Law in Illinois

Custody

I had a relationship with a Mexican lady, who moved to Mexico when she was 4 month pregnant with my baby, now she called me to tell me that if I don't want her to abandon the baby at the hospital I better there when the baby is born to get that baby, otherwise she will leave the baby at the hospital because she doesn't want the responsibility of a baby. She is willing to give me sole custody, and I need to know what are the procedure to fallow to be able to bring the baby back to the states, I live here and work here, and need to come back. Please tell me what to do.

Thank you.

Re: Custody

You need an attorney to ensure it goes smoothly. I would not suggest you attempt such a huge task without legal help.

Re: Custody

There are many issues at play here that cannot possible be covered in a simple answer. First, from yoour message it seems that this young lady is a Mexican national and not a U.S. citizen. Second, she is living in Mexico and is intent on having the baby in Mexico. You are dealing not just with U.S. law but with Mexican law as well. To bring the baby back to the U.S. you will have to prove to U.S. immigration that it is in fact your child (for example, medical tests, acknowledgement by the mother, etc.)This is not to mention what must be proved to the Mexican authorities.

Because of the complexity of the case I urge you to contact an attorney regarding this issue.

I would be willing to set up an appointment with you to discuss this matter. If you wish, please call my office at (312) 236-9906.

Very truly yours,

Thaddeus J. Hunt, Esq.
