Legal Question in Family Law in Illinois

custody of my unborn child

I am now six months pregnant by someone who never wanted to have kids. He kept telling me I needed to get an abortion, but I dont believe in that. He has physically and mentally abused me the entire time I have been pregnant and still says he wishes I would have got an abortion, he recently left me for someone else and has been threatening that he will take the baby from me when it is born, he is determined, how do I make sure he does not do this? Also, he says he is going to tell them that I have done drugs while being pregnant, how do I prove that it is not true and will they believe him over me?

When your baby is born you should hire an attorney to file a Petition for Determination of Paternity. If hte court requires you to do so you can take a drug test and prove that you are clean. If you have been on drugs during your pregnancy, you have endangered the baby and you face the risk of losing the baby to the state, or conceivably to the father. The court will allow evidence such as the results of DNA testing if there is any issue as to who is the father. The court will make an appropriate order for child support and may also approve a plan that provides for custody of the child which allows some parenting time to the father. If you need protection from this man's ause, there are laws for that. Consult with and hire an attorney as soon as you can. Do not let this man intimidate you. Do what is best for your child.

This man cannot force you to have an abortion. You should immediately seek a protective order if he is abusing you. And no matter what he says, he is obligated to pay child support if he is the father, so you should definitely seek an attorney.

All that is silly. You will almost certainly get custody, and he will be forced to pay child support. Which is why he is making idle threats. Just make sure you get a lawyer and make sure the proper orders are entered.
