Legal Question in Family Law in Illinois

a new law stating Parents in a joint-custody relationship must first offer the other parent the option of temporarily caring for a child before seeking third-party child care was put into effect this year but my ex wife has spoken to an attorney and now believes that this law does not apply to us because that attorney told her it still needs to be stated in our divorce papers is this true and how exactly does this law work
