Legal Question in Family Law in Illinois

taxes, taxes, taxes

my ex called me up three months after she moved out of the house and said she was pregnant and was having the baby. i know its mine and have been paying $225 a pay period since he was born almost a year ago, but have only seen him a few times, but am doing the right thing and paying the money.

my ex refuses to let me claim him on my taxes every other year though because she says she is the one who gets up at night with him and takes care of him, but it was her choice to have the child and she knew I didn't want any more kids (I have children from a previous marriage).

am i legally entitled to the every other year exemption because i pay support even though the child doesn't live with me?

You need to go to court and and ask a judge for that. Also, and more importantly, you have a legal right to see the child. It sounds like you need to assert various rights in court. Lastly, as to the "I didn't want the child", that is not relevant to any of your issues.
