if a owner has in a lease that he will not pay for damages to your property but the damages were a result of a preexisting problem/can he be sued?

The answer is, it depends. Did owner know about the condition; was it open and notorious? Was anybody injured or is there just property damage? Does owner's insurance provide coverage in any way (if so, insurer would have to rpovide counsel). If you are already being sued, you should consult counsel and not wait. Most court deadlines approach quickly. Hiring a lawyer, the right lawyer, takes time.
